These Indeed Text2Apply Beta Terms of Service (“T2A Beta Terms”) incorporate the Indeed Terms of Service (the “Agreement”), and apply to any person who accesses or uses Text2Apply, or who otherwise indicates their acceptance of these T2A Beta Terms. By agreeing to the T2A Beta Terms, you also agree to the Indeed Terms of Service.
Any capitalized words that are used but not defined in these T2A Beta Terms have the meaning set forth in the Agreement. Any terms of the Agreement applicable to Job Seekers shall also apply to you or any person who accesses or uses Text2Apply to apply to a Job Ad, including but not limited to a person who texts the keyword associated with the Job Ad to the telephone number appearing in the Job Ad and/or Sign. The term “Site” as defined in the Agreement shall include Text2Apply. The term “User Content” as defined in the Agreement shall include any text messages you send through Text2Apply. The term “Sign” means a visual material, including but not limited to, paper sign, magnet, table tent, or another item or material that Indeed provides the Employer, and which the Employer can display in their business or in relation thereof, containing the keyword and telephone number associated with the Employer’s Job Ad. “Job Ad” as defined in the Agreement shall include the job advertised in the Sign.
TEXT2APPLY IS STILL IN TESTING PHASE AND IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, MAY CONTAIN DEFECTS, AND A PRIMARY PURPOSE OF THIS BETA TEST IS TO OBTAIN FEEDBACK ON THE PRODUCT PERFORMANCE. YOU ARE ADVISED TO SAFEGUARD IMPORTANT DATA, TO USE CAUTION AND NOT RELY IN ANY WAY ON THE CORRECT FUNCTIONING OR PERFORMANCE OF THE BETA PRODUCT AND/OR ACCOMPANYING MATERIALS.
You understand that the questions, such as screening questions, sent to you as part of the Text2Apply application to the Job Ad, are chosen by the Employer and that Indeed shall not be responsible for the content of any of these text messages. You also agree that Indeed is not responsible for the content of a Job Ad or the Sign, including the placement of the Sign. You agree that if you require alternative methods of application or screening, you must contact the Employer directly.
By texting the keyword to the telephone number provided in connection with Job Ad, appearing on the Site or a Sign, or by answering any questions or replying via text message, you consent to receive autodialed text messages about the Job Ad, including but not limited to, information related to your subscription to the Text2Apply service, the Job Ad or application, the application itself (e.g. screening questions), and updates or reminders about the application, to the telephone number from which you use Text2Apply. You understand that a keyword may be inactive or unavailable when you text an Employer and that Indeed is not responsible for sending your information to an Employer once an opportunity has expired or been cancelled. You also understand and agree that messages and data rates may apply as a part of your use of Text2Apply.
Your application will not be considered complete until you have answered all questions in the correct format. Indeed will forward completed applications to the Employer. You understand and agree that Indeed may share the screener questions and your answers with the Employer in the form of a transcript. Please note this transcript is provided solely as a courtesy and Indeed does not guarantee its delivery or receipt. However, we reserve the right to not forward all or part of your answers to the Employer in our sole discretion. For example, Indeed may not forward your application, or parts thereof, if you use Text2Apply in an abusive manner. If you have an Indeed account, Indeed may recognize that you are an Indeed account holder for analytics purposes, but your application will not be displayed in your Indeed profile, for example under “Applied Jobs.” You understand and agree that it may take a few days for your completed application to be forwarded to the Employer. As Text2Apply is in testing phase, Indeed does not guarantee that your application will reach the Employer. In the event a Text2Apply Job Ad becomes unavailable before you complete and submit your application, you agree that Indeed is not responsible for forwarding your information to the Employer for that opportunity. You also understand that you may apply to the Job Ad on https://www.Indeed.com.
You may unsubscribe from the Text2Apply service at any time by texting the word “STOP” to the telephone number provided in the Job Ad. Doing this will unsubscribe you from the service and pause any incomplete application. You acknowledge and agree that Indeed may send you one additional text message to confirm you are unsubscribed from the service. Unsubscribing from the Text2Apply service after you have completed your application will not stop Indeed from sharing your application with the Employer listed in the Job Ad. You may resume the Text2Apply service and any incomplete application at any time by texting the word “START” to the telephone number provided in the Job Ad. Note that unsubscribing from Text2Apply only applies to Text2Apply alerts and will not impact other text subscriptions you may have with Indeed.
PLEASE NOTE THAT DUE TO THE CONVERSATIONAL NATURE OF THIS SERVICE AND THE UNRESTRICTED FORMAT OF SMS TEXT MESSAGES, INDEED CANNOT GUARANTEE IT WILL HONOR AN UNSUBSCRIBE REQUEST MADE BY TEXT MESSAGE UNLESS IT IS LIMITED TO THE SINGLE-WORD “STOP”. INDEED EXPRESSLY MAKES NO REPRESENTATION AND DOES NOT GUARANTEE THAT IT WILL RESPOND TO ANY OTHER FORM OF REQUEST BY TEXT MESSAGE TO UNSUBSCRIBE FROM THIS SERVICE. YOU MAY ALSO CONTACT US AT TEXT2APPLY @ INDEED.COM OR SUPPORT.INDEED.COM FOR MORE INFORMATION AND TO UNSUBSCRIBE.
You may also text “HELP” at any point to receive a text message with instructions on how to receive more information about the Text2Apply service and on how to unsubscribe.
You represent and warrant that (a) all your information is correct and current; (b) that you are the subscriber and primary user of the telephone number from which you use Text2Apply; and (c) you will not use Text2Apply in an abusive manner or in furtherance of an illegal activity. Violation of these policies may result in immediate termination of your application without notice, and may subject you to legal penalties and consequences. Indeed may reject or remove any content posted via Text2Apply, and Indeed may cancel your application for any or no reason without notice.
INDEED’S PROVISION OF TEXT2APPLY AND THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WITH RESPECT TO TEXT2PPLY AND YOUR USE THEREOF, INDEED AND ITS AFFILIATES, AND ITS AND THEIR THIRD-PARTY LICENSORS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION FOR NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW: (a) NEITHER PARTY WILL BE LIABLE UNDER THESE T2A BETA TERMS FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY; AND (b) EACH PARTY’S AGGREGATE LIABILITY TO THE OTHER UNDER THESE T2A BETA TERMS IS LIMITED TO AMOUNTS PAID OR PAYABLE TO INDEED.
You agree to defend, indemnify and hold harmless Indeed from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from or related to: (a) your violation of any term of the T2A Beta Terms; and (b) your use Text2Apply, including but not limited to, using a telephone number for which you are not the subscriber or primary user.
By using Text2Apply and in return for the services offered by Indeed, you acknowledge that Indeed can only offer you these services under the terms and conditions as presented herein.
As partial consideration for your use of Text2Apply and the services provided thereunder, you agree not to sue Indeed as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against Indeed regarding your use of an Indeed service, including but not limited to, Text2Apply. Additionally, as a Job Seeker, your use of Text2Apply is at no charge from Indeed and you acknowledge that part of the price you are paying to use Text2Apply is your acceptance of these terms of service including this Class Action Waiver. If you do not agree to any part of these terms, do not continue your use Text2Apply and reply STOP via text message. Nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff, including in small claims court, subject to section 11 of the Indeed General Terms of Service.
